General Overview of Bankruptcy

Every year the bankruptcy system (the judge and the bankruptcy trustee) requires more and more documentation. The easiest way to put it is that they don’t take “anyone’s word” for things anymore. I like to say they want “paper proof” of everything, and I mean everything. When we’re preparing your case, we might say, “we need such and such.” What we mean by that is that the bankruptcy trustee will want that information. Most of the time we want to gather all the documents before the bankruptcy is filed because the trustee might put a strict deadline on when he/she receives something and if he/she doesn’t have it, your case will get thrown out.

Forbearance

If you can afford your house payment, do NOT sign on for a forbearance (if you can afford your house payment). If your mortgage company automatically signs you up (they’re not supposed to), make sure you call them and cancel it (if you can afford your house payment). What is meant by “if you can afford your house payment”? If your income has not gone down, do NOT sign on for a mortgage forbearance. Many people are getting into trouble because their mortgage company is declaring that the missed payments are due right now. Mortgage companies say they will offer ways to pay it back, but legally, they don’t have to. This leaves people in a bad way.
